Does the works council co-determine remote work?
In companies with a works council, the design of mobile work is in principle subject to co-determination (section 87(1) no. 14 BetrVG). This concerns the general framework – not every individual decision in day-to-day work.
Typical topics are the distribution of working time, availability, equipment, technical monitoring and rules on using rooms and work equipment. In practice this results in a works agreement on mobile work.
A good agreement covers scope, prerequisites, days and core hours, availability, equipment, safety, data protection and a change process.
