Why a hybrid work policy is non-negotiable
Hybrid work is the default in most knowledge-work companies — but only a fraction have a documented policy in place. That gap is where risk lives: unclear expectations between employees and managers, incomplete occupational-safety coverage at home, unresolved data-protection questions, and in the worst case employment-court disputes. A written policy creates accountability, transparency and legal clarity.

The Workplace Ordinance (ArbStättV Annex 6) defines concrete ergonomic minimums for teleworking. The Occupational Safety Act (ArbSchG) obliges employers to perform a risk assessment — at home too. The GDPR requires technical and organisational measures for processing personal data outside the office. Where a works council exists, introducing hybrid models is subject to co-determination under §87 (1) no. 14 BetrVG.

Frequently asked questions
What belongs in a hybrid work policy?
A complete hybrid work policy covers scope, office days, core hours, equipment, occupational safety, data protection, working from abroad, cost coverage, insurance, revocation and co-determination. Our generator covers all 12 mandatory areas.
Is a hybrid work policy legally required?
There is no statutory obligation to maintain a written policy, but German occupational safety law (ArbSchG), the Workplace Ordinance (ArbStättV incl. Annex 6) and the GDPR require clear rules. In companies with a works council, introducing hybrid models is subject to co-determination under §87 BetrVG.
Can I use the generated policy directly?
The template covers all practically relevant topics and reflects common market standards. Before going into effect, it should be reviewed by your legal team or an employment lawyer and – where applicable – aligned with the works council.
Are my inputs stored?
No. The generator runs entirely in your browser. No data is sent to or stored on any server. You can download the finished policy as a Markdown file.
How many office days per week make sense?
2–3 mandatory office days have become the de-facto standard. Less than 1 day weakens team bonding, more than 3 erodes the hybrid promise. The number matters less than treating office days as deliberate team days.
