Responsibility for occupational safety stays with the employer, even when work happens in a private home. Section 5 of the German Occupational Safety Act requires a risk assessment for every activity – display work at home included. For teleworking workstations under the Workplace Ordinance, workplace requirements apply on top.
There is no right of access to the home without consent. That makes a documented employee self-declaration, combined with instruction and traceable measures, the practical and accepted route.
There is no fixed deadline. Common practice is an assessment when the workstation is set up and then every one to two years – plus always on relocation, changed tasks, new equipment or after an accident.
Missing risk assessments can trigger fines and recourse claims in case of damage. After a home office accident, the accident insurer examines the link to work – clean documentation of working conditions is your key basis.

For screen work, section 10(2) MuSchG requires the work to be designed so that regular short interruptions or other tasks are possible.
Read answerTelework is a screen workstation permanently set up by the employer in the employee's home and falls under the German Workplace Ordinance. Mobile work is location-independent work without a fixed workstation; 'home office' is an everyday term for both.
Read answerYes. Under section 3(1) of the German Occupational Safety Act the employer must take the necessary safety measures and verify their effectiveness. This includes the risk assessment under section 5 ArbSchG. These duties also apply to workstations in private homes.
Read answerNo. The home is protected by Article 13 of the German constitution, so the employer has no general right of entry. However, employers can require employees to cooperate – for example through a digital risk assessment.
