Workplace Ordinance (ArbStättV)
Germany's Workplace Ordinance defines minimum requirements for workplaces – including telework and home offices.
The German Workplace Ordinance (ArbStättV) implements the Occupational Safety Act and sets minimum standards for safety, health, and ergonomics – with explicit relevance for home office and telework arrangements.
Scope
Since the 2016 amendment, telework is explicitly covered (Annex No. 6). For purely mobile work, requirements are lighter, but the underlying Occupational Safety Act still applies.
Key requirements
- Ergonomic screen, desk and chair
- Adequate lighting and daylight
- Indoor climate, ventilation, noise protection
- Breaks and movement
- Risk assessment per § 3 ArbStättV
Employer duties
Even at home, the employer remains responsible. This means providing ergonomic home office equipment, instruction, and risk documentation. See our Equipment Pillar Guide for details.
Penalties
Fines up to € 5,000 per case (§ 9 ArbStättV with § 25 ArbSchG); in serious cases criminal prosecution. More importantly: civil liability for health damages and reputational risk.
